Terms & Conditions and Refund Policy
All orders must be paid in full prior to shipping. Kloubec Koi Farm guarantees live delivery on all Koi purchased through our website. Each Koi undergoes a thorough quarantine process before shipment. However, we strongly recommend that all new fish be quarantined by the buyer before introduction into any pond or water garden.
Orders for live Koi may be canceled prior to shipment; however, a 30% restocking fee will apply. This fee iscalculated based on the total value of the canceled fish and reflects the time, labor, and holding space dedicated to preparing your order. Cancellations must be requested in writing and confirmed by Kloubec Koi Farm. Buyers must be available to receive the shipment on the scheduled delivery date or must arrange alternative plans with Kloubec Koi Farm in advance. If there is any loss upon arrival, a claim must be submitted within three (3) hours of delivery and must include a clear photo of the affected fish. Upon verification, Kloubec Koi Farm will issue either an in-store credit or a refund for the value of the lost fish. The method of compensation will be determined based on the circumstances of the claim.
For the safety and health of our live fish population, all sales of live animals are final and non-returnable. Returns are not accepted under any circumstances. Kloubec Koi Farm's live delivery guarantee applies only to the moment of arrival and does not extend to any environment beyond our control, such as ponds, lakes, quarantine systems, or other bodies of water. The purchaser assumes full responsibility for the health and well-being of fish after delivery.
By placing an order, the buyer agrees not to initiate a chargeback or payment dispute with their credit card provider, bank, or any other payment processor for purchases made from Kloubec Koi Farm.
Shipping costs vary by location. All Koi orders placed online are shipped via UPS Overnight Service to ensure safe arrival. Great care is taken during packaging, and we reserve the right to determine the number of shipping boxes required to maintain the health of the fish in transit. Local pickup is available by appointment only. On rare occasions, a specific Koi may become unavailable due to injury or other unforeseen circumstances before shipment. In such cases, Kloubec Koi Farm will issue a refund or apply an in-store credit for the value of the fish.
For items other than live fish, we offer a 15-day return policy. Merchandise must be in new condition, in its original packaging, and accompanied by the original sales receipt to be eligible for a refund. Return shipping costs are the customer’s responsibility unless the return is due to an error made by Kloubec Koi Farm. Refunds for eligible items will be issued within two (2) business days of receiving and inspecting the returned merchandise.
By using this website and making a purchase, you agree to release and hold harmless Kloubec Koi Farm, its owners, employees, and affiliates from any and all liability, claims, losses, or expenses arising from your use of the site or breach of these terms. You also agree to indemnify and hold Kloubec Koi Farm harmless against any damages, including legal fees, resulting from such breaches.

The Kloubec Koi Farm mobile message service (the "Service") is operated by Kloubec Koi Farm (“Kloubec Koi Farm”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Kloubec Koi Farm’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Kloubec Koi Farm through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Kloubec Koi Farm. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18557994830 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Kloubec Koi Farm mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
